Mayor Vetoes Decision-Reinstates Assistant position-City Attorney Terminated

On Day 101 of being the newly elected Mayor for The City of Eudora, Mayor Tomeka Butler had five out of eight city officialsserved with certified letters on Friday by Chicot County Sherriff Ron Nichols. (Reference County Sherriff) Sheriff Nichols served City Alderwomen Charleen Taylor, Faye Moye, Danita Turner, Ezell Minniefield, and Alderman Robert Thomas Jr. There was an attempt to serve Alderwoman Mary Harris who refused to comply and Eudora City Attorney Viki Lucas who was unable to be reached at the time.

Mayor Butler, who is being represented by Attorney Chris Burks of WH Law, is challenging a resolution of a hiring/firing freezeattempted on Monday (June 15, 2020) of last week during a special call meeting as well as the roles and duties of city officials and those of the Mayor.  

The letter states the continued illegal act of Eudora City Council and the violation of Arkansas Law regarding to comply with the Arkansas Freedom of Information Act. A.C.A. § 25-19-101 et seq.

Eudora City Council passed a resolution that was illegal according to the letter from Attorney Burks (Reference attorney letter)

The meeting on June 15, 2020 (referencing the article in last week’s circulation), was also illegally called as the correct form to request the meeting was not used, nor was notice given to the Mayor, nor did she approve it.  The resolution attempted to be passed also violates Arkansas law.  Specifically, Mayors have the exclusive right to appoint and remove any and all department heads subject to a two-thirds override by the city council. A city council may not initiate the appointment or removal of a department head under this statute. See A.C.A. § 14-42-110.  Implicit in this authority is also the authority over employees under department heads.

Mayor Butler vetoed the decision Thursday and has a statement on file with Eudora City Clerk Prustina Curry, also reinstatedthe position of Assistant to the Mayor and asked for the resignation of City Attorney Vicki Lucas.

Mayor will continue to seek legal action if the Council does not adhere to Arkansas law.
